Q. 25 years ago I plead to the charge of Assault with a deadly weapon and it was a firearm. The case was expunged, dismissed, the plea of guilty changed to not guilty, and the felony was reduced to a misdemeanor, and I thought I was clean. Now 25 years later I find out this charge prevents me from owning a firearm. Is there anything I can do to restore my 2nd amendment right? Clean record prior to charge, and clean record since. Unless the ADW conviction involved an assault on a peace officer, there would be no inhibition upon ownership of a firearm under California law. (A misdemeanor ADW carries a 10-year ban, but that has long passed.) However, if this had anything to do with domestic violence, there is a federal firearm ban. Neither the reduction to a misdemeanor nor the 1203.4 order change that. If this conviction did NOT involve domestic violence, then I can see no basis for asserting that you cannot own a firearm.
